What do you do when there is “UNAUTHORISED USE OF YOUR MATERIAL”?

If you have a copyrighted piece of work and it is being used with out permission with someone, there is generally only two things you can do about it.

First if you have money for lawyers you can straight out file a lawsuit against the person infringing your copyright.

Before doing so however you would normally contact the person infringing copyright via email or mail and write them a letter explaining what law they are breaking and how they are doing so. And then demand that they cease using your copyrighted material.

What is RIGHTS MANAGEMENT?

RIGHTS MANAGEMENT refers to technologies that are used to control access or use of digital content.
Limitations of the use of digital content which has DRM (Digital Rights Management) is imposed to protect copyrighted material.

How does it work?

Different DRM Technologies are implemented to protect different types of digital content.

Content Scrambling System (CSS) is a technology that uses a simple encryption to encrypt DVD discs.
Device manufacturers are required to sign license agreements that restrict the inclusion of features, such as digital outputs that could be used to extract digital content.

Audio CD’s are also encrypted, however DRM is not legitimately standards compliant with Compact Discs used for Audio CD’s.

There is also DRM used for streaming audio/video, such as Microsoft’s Windows Media DRM, a form of digital rights management.
It is used to securely deliver content over an IP network to another PC in such a way that the distributor can control how the digital content is used.

When Creating New Material – Protecting It

When creating new material in order to protect it you must copyright it.

1. Ensure that your work has a copyright statement on it.

2. Agreement between co-author of the work, if they exist must be established.

3. Your copyrighted work does not breach the copyright of someone else.

Asking permission for the sole reason of using the image as an example of requesting to use a copyrighted image to complete part of a TAFE College unit I am studying at the moment.

What do you need to put in a Copyright Clearance Request?

Your title, name, position, company, address details.
The date of your request
A title of the work to be copied and a description and citation of that work.
A description of how the work is to be used.
The signature of the person requesting the copyright clearance.

Who do you need Copyright Clearance from?

If you find that the work that you wish to use is copyrighted.
You will have to contact and get permission, a copyright clearance from the copyright owner.

When do you need Copyright Clearance?

You need copyright clearance when you have analysed your work and you have found that your work is not excluded from any copyright exemptions.

Some Copyright Exemptions:

Making temporary copies (internet browsing or sending material by fax)
Library privilege (copying on behalf of customers, but not artistic works)
Judicial proceedings
Abstracts (but not from an abstracting bulletin, as this is a database with its own associated rights)
Incidental inclusion (where something is unintentionally included such as a poster in a film)
Reading in public (with due acknowledgement of author/rights-owner)
Adverts in sales catalogues
Off-air recording from television or radio (time-shifting)
Representations of works on public display (e.g. a photograph of a statue)
